The certification mark, as used by persons authorized by the certifier, certifies that the services provided have been performed by persons who have met the certifier's requirements for providing machinery and equipment appraisal services, and that as such, each person (1) has met the prerequisites for and have successfully passed an examination prepared and reviewed by the certifier and (2) has met other qualifications set by the certifier which establish that such persons are competent and qualified to provide machinery and equipment appraisal services. The owner of the mark is exercising legitimate control over the use of the mark in commerce. The owner of the mark is not engaged in the production or marketing of services to which the mark is applied, except to advertise or promote recognition of the certification program and/or services to meet the certification standards of the owner.
