In addition, my use of the trademark "Danny Diamonds" in commerce is geographically located within any location with access to the world wide web and internet domain website "www.DannyDiamonds.com" of which I am the owner and on which I advertise, market, and sell jewelry goods and custom design jewelry services using the trademark/service mark "Danny Diamonds" to represent my business of the sale of such goods and performance of jewelry custom design services. Applicant's Members/Authorized Users: The current authorized users of the trademark/service mark Danny Diamonds in relation to my business use as specified herein are myself, Daniel Zamsky, of 100 Needham Street, First Floor, Newton, Massachusetts, 02464. The name of my business entity is Danny Diamonds & Co, LLC which is registered as an LLC within the Commonwealth of Massachusetts and for which I am the sole individual owner, operator, authorized agent and/or official of such LLC, and am recognized per my EIN as a sole/exempt individual for this entity. Applicant's Sought Mode of Registration: The mode of use for which the applicant seeks registration is within the following three classes: (a) IC 014. US 002 027 028 050. G & S: Jewelry; watches; diamonds; gemstones; Precious and semi-precious stones; precious metals; (b) IC 025. US 022 039. G & S: Clothing, namely, shirts, pants, jackets; Hats; and (c) IC 035. US 100 101 102. G & S: Retail store services featuring jewelry; online retail store services featuring jewelry. Concurrent User Information: The concurrent user of the mark in question is Daniel Folmer of 1523 Meeting Street, Southlake Texas, 76092. The concurrent use by Daniel Folmer is limited to IC 009. US 021 023 026 036 038 for "Audio recordings featuring music." and IC 041. US 100 101 107 for "Entertainment services in the nature of recording, production, and post-production services in the field of music.". Concurrent User Registration Issued: The registration issued to the concurrent user as specified above is serial number 88447828 for the application filed by the concurrent user under the same serial number. Concurrent User's Geographic Area of Use: To the best of my knowledge and information, the concurrent user is using the mark in the geographic area of Texas, United States of America, most specifically including but not limited to Southlake, Texas, United States of America. Concurrent User's Goods and/or Services: To the best of my knowledge and information, the concurrent user is using the mark for the goods and services of music and audio recordings, entertainment and performance of music and live shows, and production and recording of music and audio. Concurrent User's Mode of Use: To the best of my knowledge and information, the concurrent user's mode of use is as a standard character mark. The Concurrent User's Mode of Use is further provided for within the Concurrent User's Issued Registration, stating the following: "IC 041. US 100 101 107. Time Period of Use of Concurrent User: To the best of my knowledge and information pursuant to the application of the concurrent user, the concurrent user first began using the mark on August 26, 2014 and first began using the mark in commerce on August 26, 2014.
