The mark consists of the three dimensional trade dress design of the bird feeder for which the following primary features are claimed: (a) a top cover having three expanding portions consisting of i) a first top conical shape; ii) a central circular shape; and iii) a tapered edge with a bottom lip; (b) a transparent tubular section positioned underneath the top cover and (c) a tapered skirt positioned at the lower end of the transparent tubular section having the top cover.
