Registrant of Marks '493 and '354 operates a franchise system offering tax preparation business franchises. Mark '493 is for the word and design mark TC TAX CARE Inc., attached, consisting of a shaded diamond shaped box containing the stylized letters "T" and "C" and to the right of the diamond is the wording "Tax Care" above a horizontal line and the term "Inc.", for tax services for commercial and private sector, namely, accounting services, tax preparation, planning, payroll preparation, business planning for taxation purposes, in International Class 35 (U.S. Classes 100, 101 and 102). Mark '354 is for the word mark TAX CARE, for the services of tax and taxation planning, advice, information and consultancy services, in International Class 35 (U.S. Classes 100 101 and 102). Applicant believes Registrant of Marks '493 and '354 is currently operating its tax preparation franchise system only in the state of Florida. Registrant's modes of use of Marks '493 and '354 appear to include, but are not claimed to be limited to, website and internet marketing. For Mark '493, Registrant's date of first use in commerce was November 5, 2002, its application date was October 25, 2010, and its registration date was April 24, 2012. For Mark '354, Registrant's date of first use in commerce was November 5, 2002, its application date was July 24, 2013, and its registration date was May 27, 2014. Marks '493 and '354 both continue to be in use. Except as specified in the application, Applicant is not aware of any other registrants or other persons who have the right to use the mark in commerce.

Applicant submits that the information stated in the Concurrent Use Claim and Miscellaneous Statement sections of the application provides all necessary information requested in the instant Office Action for processing of the concurrent use claim under 15 U.S.C. §1052(d), with the exception of the following revision as to Registrant's geographic area of use and the following addition as to Applicant's geographic area of use, both of which are hereby made. 1.
