1) Applicant seeks registration of the mark "LEVEL UP" for "Providing facilities for social functions," in the geographic area of the entire United States with the exception of the states of Oregon, Washington, Idaho, and that portion of the state of California north of 37? latitude 2) Applicant is providing facilities for social functions under the mark "LEVEL UP" which is used in advertising the services through print advertising, outdoor advertising, Internet advertising, and other forms of advertising for services. 3) Applicant claims an exception to its exclusive use of the mark "LEVEL UP" by one other third party use of a similar mark which includes the terms "Level Up" in the city of Eugene, Oregon 4) Applicant believes the correct name and address of the concurrent user to be Level Up, LLC 1290 Oak Street, Eugene, Oregon 97401. 4) A trademark application is pending for Ser. No. 87318967, and its first date of use is stated as April 2012. Applicant declares that no one else except as specified in the application has the right to use the mark.
