Concurrent use information. This concurrent use request is pursuant to a prior TTAB decision in Proceeding No. 94002236, which decision issued April 6, 2009. Applicant is permitted to use its mark in connection with insurance underwriting services in property, casualty, accident, liability, health, reinsurance, and surety; and insurance agency services for the area comprising the entire United States with the exception of Rhode Island because its date of first use in commerce is before any use outside Rhode Island and before the filing date of any application to register the mark that may be filed by the excepted user. The known excepted user is The Beacon Mutual Insurance Company, having an address at One Beacon Centre, Warwick, Rhode Island 02886. Upon information and belief, The Beacon Mutual Insurance Company is using its unregistered marks 'The Beacon Mutual Insurance Company,' 'Beacon Insurance,' 'The Beacon,' and a lighthouse design in connection with the promotion and sale of workers' compensation insurance and related services since July, 1992 in Rhode Island.
