Concurrent use information. 1) Applicant seeks registration of the mark "LOFTWORKS" for "Real estate listings, leasing and brokerage services" in the geographic area of the entire United States with the exception of Sacramento, California and Cleveland, Ohio. 2) Applicant is providing "Real estate listings, leasing and brokerage services" under the mark "LOFTWORKS" which is used in advertising the services through print advertising, outdoor advertising, Internet advertising, and other forms of advertising for services. 3) Applicant claims an exception to its exclusive use of the mark "LOFTWORKS" by two other third parties use of a similar mark which includes the terms "loft works" in Sacramento, California and Cleveland, Ohio. 4) Applicant believes the correct name and address of the concurrent users to be Loftworks, LLC, 1530 J Street, Suite 200, Sacramento, California 95814, no current trademark registration exists, and the Loftworks Building, 1667 E 40th Street in Cleveland, OH, no current trademark registration exists. Applicant declares that no one else except as specified in the application has the right to use the mark.
