The Parties to Cancellation No. 92063580 have agreed upon a Settlement and Release Agreement to settle the Cancellation Action fully and finally, and ensure that the Parties may use and register their respective marks in the United States without any likelihood of confusion, by each owning geographically restricted Concurrent Use Registrations. Accordingly and pursuant to the terms of the Settlement Agreement, Applicant Sam Vaziri Vance, Inc. ("Vance") hereby requests that this Application be removed from suspension, and amended to a Concurrent Use Registration, whereby this Application shall be registered in the entire United States except Florda. Vance hereby identifies The Lens Bar, LLC, a Florida Limited Liability Company, as the lawful concurrent user (excepted user) with rights in the state of Florida.
