The color(s) The Color is black and the font is italic. I created my business logo through a company name Design Mantic, Oct. 2015. I purchased the trademark for my logo that included the picture and my business name. The logo came back approved. When I received the final trademark closing documents, I discovered that pictured was only trademarked and not my company name. I contacted the trademark company and customer services waived the 2 processing fee because the trademark company required for me to do a second trademark, and the problem was their responsibility. I completed and submitted the 2nd trademark but it came back denied, due to similarities. Open Arms CDC is a private company that is very unique in its services to the community. We service children from ages 6 weeks to 12 years only from Fri 6pm - Mon 6am. There is no childcare facility that is the same as Open Arms CDC. Trademark appeal On March 2013, I, Rashonda Straite purchased a copyright for my business name (Open Arms Comm. Dev. Center), at the Mecklenburg Court House. My business name was approved and notarized and doesn't expire until 2017. In the process of, completing requirements to operate my future business as the owner and CEO, like education (I earned my A.A.S degree at CPCC in May2008. I transferred and was enrolled at Western Carolina and UNCG University, but many trials and tribulations, lead me to Catawba University, where my anticipating graduation date is Dec. 2017. In Aug. 2015 I earned my certificate for a 2 day training to operate a child care business in a building facility, which expires Aug 2017. Not approving my trademarks, when the logo was professionally created, the picture is very different from the similar named companies, and our service is also very unique to the reasons why the trademark was denied. is/are claimed as a feature of the mark.

Father more, If there was an issue with the name, then, during the 1st trademark process, the company should've have questioned then. I have the same logo created that I requested to trademark. The same name and picture that is created in the logo was attached the 1st and 2nd process requirements. I submitted the same logo to the trademark and I don't understand why the name didn't appear on the 1st trademark application but did on the 2nd one, which was denied (this is why the process fee was waived and I only had to pay for the application). I purchased 1 logo design, 2 trademark applications for $289 each and 1 processing fee for trademark for $99, due to the 2nd trademark fee being waived. I have put money into the trademark application and process and don't feel that it is correct for my "entire" logo to be denied when it is very unique from all other companies with similar names. It is also incorrect to denial my 2nd trademark because it is the same one that was approved the 1st process period. I am a single parent of 2 small children (ages 6 and 2). My 6 year old has won many trophies for dancing and girl pageants. I'm additions, my 2 year old follows her older sister in her unique ways. I work two jobs. I work as a nurse at the same company since Jan. 2008. I have been a teacher for many different early child ages, since Dec. 2008. I am opening my very 1st childcare business. I am going to operate a childcare facility from the hours of Fri 6pm- Mon 6am. I am seeking to assist families that need childcare during hours that normal business hours are not operating. Parenting requires help. I truly know what it's like to have more than one job, be enrolled in college, establishing dreams to come to reality, and have other family and life responsibilities with no childcare help, during the weekends. Open Arms CDC was created to assist families needing childcare on the weekends, with the same quality care as childcare centers that operated during the week. Small problems like trademark issues should be eliminated to the many problems I have faced and will face with operating and owning a business.
