Registration limited to the area comprising Idaho, Washington, Oregon, Nevada, Utah, Montana, and Wyoming pursuant to the decree of the Trademark Trial and Appeal Board, Concurrent Use No. 94002427, on March 23, 2011, concurrent with Registration Nos. 1979082, 1949835, 2408444, 2938611, 2961910 and 3717691.

Pursuant to the attached USPTO Order date-stamped August 23, 2011 in TTAB Concurrent Use Proceeding No. 9400247 and the attached Consent Agreement dated March 23, 2011: 1. Applicant seeks registration of the mark for the stated goods and services in the geographic area of Idaho, Washington, Oregon, Nevada, Utah, Montana, and Wyoming in the United States; 2. The mode of use is, without limitation, print advertisements, cards or other circulars and web-based or television media; 3. The exception to the claim of exclusive use is use by St. Luke's Episcopal Hospital and St. Luke's Episcopal Health System in the United States except for in Idaho, Washington, Oregon, Nevada, Utah, Montana, and Wyoming; and 4. Concurrent user: St. Luke's Episcopal Hospital and St. Luke's Episcopal Health System Application Nos. 1949835, 1979082, 9408444, 2938611, 2961910, 3717691, 4163126, and Serial No. 85613038. No one else except as specified in the application has the right to use the mark. Thus, Applicant respectfully submits that because of the TTAB's attached order in Concurrent Use Proceeding No. 94002427 and the attached Consent Agreement dated March 23, 2011, Applicant is entitled to concurrent use of the mark in this application and a further concurrent use registration proceeding is not required.
