The mark consists of the three dimensional trade dress of the packaging for ties. The packaging configuration consists of (i) a large rectangular box with a pull-out tab positioned on one of the shorter sides of the box. The silhouette of a walking panther with a straight line below and the word "THE" in the middle of the line and the words "DARK KNOT" below the line, all appearing on the front face of the box; (ii) wrapping paper containing the tie in the pull-out compartment with the same "THE DARK KNOT" design with the silhouette of a walking panther with a straight line below and the word "THE" in the middle of the line and the words "DARK KNOT" below the line appearing several times all over the wrapping paper; (iii) a ribbon attached to the inside of the box and wrapped around the wrapped tie and tied into a bow with the words "THE DARK KNOT" without the silhouette of a walking panther appearing several times on the ribbon; and (iv) a wallet size card placed inside the pull-out compartment with recommendations for suits and shirts matching to the tie written on one side of the card with a partial outline of a square with stripes next to the words "WESTPORT REPP STRIPE" followed by "WESTPORT REPP STRIPE" underneath in italics, followed underneath by the following wording, some of which is truncated because it is only partially viewable from outside the envelope sleeve: "/Navy Blue/Silver is recommended with a solid e or white and charcoal grey or navy blue ripped suit. A solid blue shirt will provide great hereas a solid white shirt will leave you with more of a classic look", the card contained partially inside a wallet size envelope. The envelope has the same "THE DARK KNOT" design with the silhouette of a walking panther appearing on one side with a straight line below and the word "THE" in the middle of the line and the words "DARK KNOT" below the line. The matter shown in broken lines is not claimed as part of the mark, and is included merely to indicate placement of the mark.
