To Applicant's knowledge: Franklin Partners, LLC, having an address at 4300 West Cypress Street, Suite 160, Tampa, Florida 33607 uses the mark URBAN JUICE CO. to identify fruit beverages, fruit juices, and vegetable juices, but Applicant is uncertain as to the additional geographic area where the mark is used and the exact nature of the products. Franklin Partners own Registration No. 4,586,067 for the mark URBAN JUICE CO. Applicant is not certain when the mark was first used although Registration No. 4,586,067 claims the mark was first used on November 1, 2013. Applicant does not know the mode of such use by the registrant. Applicant believes that no one else except as specified in the application has the right to use the mark.

Subject to Concurrent Use Proceeding with U.S. Registration No. 4,586,067. Applicant claims the exclusive right to use the mark in the area comprising the entire United States, except the City of Tampa, Florida.
