Concurrent use information. Applicant seeks registration of the "H-7" trademark for "waterless hand soap, cleaning and degreasing preparation" only for Puerto Rico and the U.S. Virgin Islands. Applicant uses the trademark by affixing it to its goods and selling them through a distributor to authorized re-sellers and retailers in Puerto Rico and the U.S. Virgin Islands. Huerta Chemical Corporation, a Florida corporation with address 2360 W. 78th St., Hialeah, Fl. 33016, and owner of Registration No. 1,316,465 for the mark "H-7" in connection with "waterless hand soap, cleaning and degreasing preparation", is a concurrent user of the mark "H-7" and has used such mark in interstate commerce at least as of March 28, 1984, as set forth in Registration No. 1,316,465. By agreement by and between Registrant Huerta Chemical Corporation and Universal Chemical Products Corp., Registrant Huerta Chemical Corporation assigned its rights and interests in the mark "H-7" in the territories of Puerto Rico and the U.S. Virgin Islands and consented to a concurrent registration by Universal Chemical Products Corp. of the "H-7" trademark, limited to the geographic area of Puerto Rico and the U.S. Virgin Islands. Registrant Huerta Chemical Corporation retains all rights to the "H-7" mark in the remainder of the United States. Registrant Huerta Chemical Corporation currently uses the H-7 trademark in connection with the goods referenced in its registration by selling such goods through authorized distributors and re-sellers in the United States, except for Puerto Rico and the U.S. Virgin Islands.
