PROFITPRO LLC's mode of use is for adjuvant for use with pesticides; agricultural seed inoculant; agricultural wetting agent; compatibility agents for fertilizers and agricultural chemicals; crop seed treatment compound, which enhances seedling vigor and performance; deposition aid and drift retardant additive for pesticides; fertilizers for agricultural use; fertilizers for domestic use; nitrogen fertilizer additive; plant growth regulators for agricultural use; seed emergence aids for agricultural crops; nutrient absorption enhancer for agricultural use; nutrient absorption enhancer for domestic use; soil amendment materials for agricultural use; soil amendment materials for domestic use; nematode suppressant for agricultural use; nematode suppressant for domestic use; and chemicals for treating animal waste in an undefined region. Granting a concurrent use in this case would NOT result in confusion, mistake or deception as the use of the name would be in a wholly different industry, for a wholly different product, and the consumer for one product would not be a consumer for the other. Moreover, the class for PROFITPRO LLC's ProfitPro registration is IC001. This application will not seek coverage under that IC classification.
