The exception to applicant's claim of exclusive use is a use by New Glarus Brewing Company ("New Glarus"), State Hwy 69, New Glarus, WI 53574, with whom Applicant has a Territory Agreement allowing New Glarus exclusive use of the term "Back 40" for their "Back 40 Bock" beer in the geographic area of Illinois, Iowa, Michigan, Minnesota and Wisconsin.
