Applicant seeks registration of the mark for restaurant and bar services; clothing; sunglasses; mugs, drinking steins, drinking glasses and shot glasses, in all geographic areas of the United States except within a 100 miles radius of Camp Hill, Pennsylvania. 2. Applicant's mode of use of its mark is through its restaurant and bar services; online sales and promotion of the goods listed in 1. above (provided it is not libelous, denigrating, disparaging or uncomplimentary to, or suggesting affiliation with, REHMAN SONS LLC); and all other means of selling and promoting its above-listed goods and services, except within 100 miles of Camp Hill, Pennsylvania and except using the appearance, theme or décor already used by REHMAN SONS LLC in connection with its mark and related goods and services. 3. The exception to Applicant's claim of exclusive use in any use by REHMAN SONS LLC, related to its claim to have been using its mark ROCK N BREW in commerce in connection with Restaurant and bar services and clothing, in Camp Hill, Pennsylvania since January 1, 2007. 4. The concurrent user is REHMAN SONS LLC, with an address of 410 St. John's Church Road, Camp Hill, PA 17011, owner of U.S. Registration No. 3389378. The concurrent user's mode of use of its mark is through its restaurant in Camp Hill, Pennsylvania; online sales and promotion (provided it is libelous, denigrating, disparaging or uncomplimentary to, or suggesting affiliation with, Applicant); and all other means of selling and promoting its goods and services, except outside a 100 mile radius of Camp Hill, Pennsylvania and except using the appearance, theme or décor used by Applicant in connection with its mark and related goods and services. 5. Applicant also submits herewith a verified statement that no one else except as specified in the application has the right to use the mark.
