Applicant seeks registration for the mark "NUTRI LIFE INTERNATIONAL" for these goods and services: (1) Retail services by direct solicitation by sales agents in the field of cookware and water filtration products in International class 035; and for this geographic area: The continental United States, Alaska, Hawaii, and all U.S. territories except Puerto Rico; (2) The mark is used on product packaging, signs on salespeople's vehicles, and salespeople's name tags, as shown in the evidence submitted with the application. (3) Applicant disclaims and excepts the following uses from its claim of exclusive use: a. Andrew Bert FOTI may use b. the mark "NUTRALIFE" c. within the U.S. territory of Puerto Rico d. for cooking strainers; cookware, namely, pots and pans; cookware, namely, steamers; frying pans; pans; and skillets; e. for so long as U.S. registration no. 3,815,143 remains valid and in good standing. (4) Upon information and belief, the concurrent user, registrations issued, and mode of use are: a. Andrew Bert FOTI, an individual residing at Bda. Buena Vista 167 Quisqueya Street San Juan, Puerto Rico 00917 b. U.S. Registration No. 3,815,143 for "NUTRALIFE" c. used in connection with the marketing and/or sale of cookware.
