The mark consists of the placement and appearance of an emblem on the packaging for the goods. Each approximately 3-inch square, 3/4-inch thick brownie is enclosed in a transparent wrapper, with the transparent wrapper sealed on opposing ends. Centered on the front of the wrapper is a round emblem approximately 2-3/8 inches in diameter. The emblem consists of a metallic silver circle surrounded by a purple rim about 1/16th inch wide. The entire package measures approximately 3-1/4 inches high, by 4-5/8 inches wide, by 3/4 inch thick. The dimensions of the brownie and of the overall package, and the transparent wrapping sealed on opposing ends are not claimed as features of the mark and are represented in dotted lines to show placement of the mark. The mark comprises the round, metallic silver emblem with a purple rim. The colors black, white and non-metallic gray appearing in the mark represent background outlining, shading and/or transparent areas and are not part of the mark.
