The mark consists of the outlined shape of the graphically depicted bottle shown on the specimen submitted. In the specimen, that outlined is achieved by graphic techniques consisting of the dark purple color for the bottle terminating against a lined, stripped contrasting colored background. It is not achieved by an actual black line. The strict drawing requirements of the PTO do not permit the use of any of the colors or any of the graphical elements that are actually used on the specimen in order to depict the mark in the drawing. Since drawings must be in black and white only and since gray scaling and shading are not permitted, the only practical way to depict the outlined shape which appears in the specimen (and which comprises the mark) and be in conformity with the PTO drawing requirements, is to depict the outlined with a black line. Accordingly, it is submitted that the display of the mark on the specimen does conform to the drawing-given the constraints imposed by the CFR and that the specimen should be accepted.
