The Mark consists of the following elements and colors, each of which is claimed as a feature of the Mark: (a) the words "cupcakes by heather & lori" are "chocolate" dark brown, which is outlined in "warm" beige, followed by "warm" pink; (b) the cupcake image is positioned inside three concentric ovals, of which the outer oval is "cream" beige, the middle oval is "chocolate" dark brown, and the inner oval is "warm" pink; (c) inside the inner oval, the image of the cupcake is further outlined in "warm" pink, and the remainder of the inner oval is filled in with "salmon" pink; (d) the decoration on top of the cupcake image is a circle within a circle, of which the the inner circle is "cream" beige, the outer circle is "chocolate" dark brown, and the remainder of the outer circle is filled in with "salmon" pink; (e) the frosting on the cupcake image is "cream" beige and the frosting swirls are outlined in "chocolate" dark brown; and (e) the cupcake wrapper is "warm caramel" brown and the wrapper shape and ridges are "chocolate" dark brown.
