"Mindful Mitigation" is a distinctive set of words which, together, are suggestive of both the nature of the business and the attitude with which the business is to be conducted. The term suggests a unique brand which is thoughtful and pragmatic in its approach to the treatment and abatement of risk (providing risk management services). Mindful Mitigation is believed to be an unique suggestive term which is not likely to be confused with either of the pending applications referenced in the Office Action letter. Ser. No. 78548929 Mindful Selling and ser. No. 78548928 Mindful Leadership are intended to be used for goods/services in "the fields of business management, sales, leadership, marketing general communications and executive coaching". This describes several functions within a much more generic business space and describe what has, at best, a most most modest overlap with operational risk management.
