The mark consists of the trade dress of an electromagnetic energy outputting device. The trade dress is comprised of a three-dimensional configuration formed by the following integrated elements, namely, a translucent base portion, a middle portion bearing the form of a fiber-optic shaped member, and a translucent end portion bearing the form of a fiber-optic shaped member. The applicant claims a glowing effect, which occurs when the device outputs visible light, as a feature of the mark, namely, the base portion and the end portion glow when the device outputs visible light. The said three-dimensional mark may be reproduced in any color and combination of colors.
