Subject to concurrent use proceeding with J&H Foods, Inc. Applicant claims exclusive right to use the mark for the states of North Carolina, South Carolina, Tennessee, Kentucky, Indiana, Ohio, all of Arkansas except for the counties of Crawford and Sebastian and the city of Bentonville, and all of Texas except for an area enclosed by lines 20 miles on either side of the centerline of Interstate Highway 35 (hereinafter "I-35") and the northern boundary of the city of Waco, and the southern ends of these lines being located 10 miles south of I-35 and the southern boundary of the city of San Antonio. In Oklahoma, applicant claims exclusive right to use the mark in a four-mile radius around four restaurants located at 121 W. Kenosha Avenue in Broken Arrow, 33 S. Sheridan Road in Tulsa, 19322 E. Admiral Boulevard in Tulsa, and 6161 S. 33rd Street in Tulsa, respectively.
